This Privacy Policy is incorporated into and subject to our Terms and Conditions. Capitalized words used but not defined in this Privacy Policy have the meaning given to them in the Terms and Conditions.
PLEASE READ THIS PRIVACY POLICY CAREFULLY because it affects your rights under the law. By using the App, you confirm that you have read and agreed to be bound by this Privacy Policy. If you do not agree with this Privacy Policy, you may not use or access the App.
- PERSONAL INFORMATION. “Personal Information” means any information relating to an identified or identifiable natural person. We do not collect Personal Information through the App. Nevertheless, if you contact us, we may collect any Personal Information that is included in the communication that you sent to us.
- NON-PERSONAL INFORMATION. “Non-Personal Information” means information that does not personally identify a person but may include tracking and usage information about a person’s location, demographics, use of the App, and the internet. When you interact with the App, we may collect your Non-Personal Information, and our servers may automatically keep an activity log of your use of the App.
- USE OF INFORMATION.
- App. We use the information that we collect to provide the App, including creation of your account, processing the content that you share in the App, and sending you notifications. The legal bases for this processing are contractual necessity and legitimate interest.
- Communications. We use the information that we collect (which can include your communications) to respond to your requests, send you messages about the availability of the App, security, or other service-related issues. The legal bases for this processing are consent and legitimate interest.
- Measure, Support, and Improve the App. We use the information that we collect to measure use of, analyze performance of, fix errors in, provide support for, improve, and develop the App. The legal bases for this processing are contractual necessity and legitimate interest.
- Recommendations and Personalization. We use the information that we collect to recommend features or content that might be of interest to you, identify your preferences, and personalize your experience with the App. The legal basis for this processing is consent and legitimate interest.
- Security and Investigations. We use the information that we collect for security, fraud prevention, and investigations. We use your data (including your communications) if we think it’s necessary for security purposes or to investigate possible fraud or other violations. The legal basis for this processing is legitimate interest (detection and prevention of fraud).
- Comply with Legal Obligations. We use the information that we collect where necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
- Protection of Rights. We may process Personal Information where necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights, and the legal rights of others.
- With Your Consent. We may also ask for your consent to use your Personal Information for a specific purpose that we communicate to you. You may withdraw your consent at any time, and we will stop any further processing of your Personal Information for that purpose.
- We never share your Personal Information. We never sell nor license your Personal Information. Should we need to process your Personal Information for a new purpose entirely unrelated to the above, we will inform you of such processing in advance and you may exercise your applicable rights in relation to such processing.
- COOKIES AND OTHER TECHNOLOGIES.
- We use cookies, pixels, web beacons and other similar technologies to recognize your device, learn more about your preferences, provide you with essential features and services, and for additional purposes, including:
- Recognizing you when you visit or use the App. This allows us to provide you with recommendations, display personalized content, and provide other customized features and services;
- Keeping track of your specified preferences. This allows us to remember your likes and dislikes, such as your configuration preferences;
- Conducting research and diagnostics to improve the App;
- Improving security; and
- Reporting. This allows us to measure and analyze the performance of the App.
- You can disable and manage cookies through your device settings. Check the support site for your device to understand privacy settings available to you. If you block or reject some cookies, you might not be able to use some functionalities of the App.
- We use cookies, pixels, web beacons and other similar technologies to recognize your device, learn more about your preferences, provide you with essential features and services, and for additional purposes, including:
- COMMUNICATIONS. We do not send advertising and marketing communications. Nevertheless, we may still need to send you administration communications from which you cannot opt-out.
- BREACH NOTIFICATION. In the event of a breach or intrusion of or otherwise unauthorized access to your Personal Information, we will notify you in the most expedient time possible, without unreasonable delay. We will notify you via written or electronic notice, or if these avenues are unavailable, through a general notification on the App or state-wide media outlets.
- YOUR RIGHTS.
- Subject to applicable laws, the following are your rights pertaining to your Personal Information:
- Right to Access. You have the right to ask whether we hold Personal Information about you and request copies of such Personal Information and information about how it is processed.
- Right to Correct. You have the right to request that inaccurate Personal Information that we hold about you be corrected, taking into account the purposes of the processing, to have any incomplete Personal Information about you completed.
- Right to Delete. You have the right to request deletion of your Personal Information that is: no longer necessary for the purposes underlying the processing; processed based on withdrawn consent; processed in non-compliance with applicable legal requirements; and you object to processing, under certain rules of applicable data protection laws.
- Right to Restrict. You have the right to request us to restrict the processing of your Personal Information where: the processing is inappropriate; you contest the accuracy of the Personal Information; the processing is unlawful, but you oppose erasure; we no longer need the Personal Information for the purposes of our processing, but you require Personal Information for the establishment, exercise or defense of legal claims; and you have objected to processing, pending the verification of that objection.
- Right to Object. You have the right to object to our processing of your Personal Information on grounds relating to your particular situation, to the extent that the legal basis for the processing is that the processing is necessary for: the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or the purposes of the legitimate interests pursued by us or by a third party.
- Right to Information Portability. You have the right to request portability of your Personal Information that you have provided to us (which does not include information derived from the collected information), where the processing of such Personal Information is based on consent or a contract with you and is carried out by automated means.
- If you want to exercise any of your rights, please contact us. Additionally, you may have the right to appeal the denial of any of these rights by submitting a form that will be provided to you if we deny a data request. We will not discriminate against any consumer for exercising their rights.
- Subject to applicable laws, the following are your rights pertaining to your Personal Information:
- DATA RETENTION. We retain Personal Information for as long as subscriptions are active or as needed to provide the App, comply with our legal obligations, resolve disputes, and process your requests. We will safely dispose of information that’s no longer needed.
- ADDITIONAL TERMS FOR EU CITIZENS.
- Controller Information. We, Jon Lucas, are the data controller of your Personal Information that we collect through the App.
- Information Transfer. In some cases, it may be necessary for us to store your Personal Information to countries outside the European Union (EU)/European Economic Area (EEA) or any other non-EEA country not considered by the European Commission to offer an adequate level of protection. In such cases, apart from all appropriate safeguards that we implement, in any case, to protect your Personal Information, we have put in place additional adequate measures.
- ADDITIONAL TERMS FOR US CITIZENS.
- California Civil Code Section 1798.83 allows users of the App that are California residents to request certain information regarding our disclosure of the information they provide through the App to third parties for their direct marketing purposes.
- California Do Not Track Disclosure. We do not track the personally identifying information of our users and visitors over time and across third party websites to provide targeted advertising, and therefore, we do not respond to Do Not Track (DNT) signals.
- Colorado Privacy Act. We do not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act.
- INQUIRIES AND COMPLAINTS.
- If you have any privacy complaints, please contact us. We try to reply to all legitimate requests within one month from receiving them. In some particular cases (for example, if the matter is particularly complex or if you send us multiple requests), it may take us longer than a month. In such cases, we will notify you accordingly and keep you updated.
- If you are not satisfied with the outcome of a complaint, or if you are concerned about a potential violation, you also have the option to report the issue or make a complaint to the data protection authority in your jurisdiction.
- REVISIONS. Our App changes constantly, and so our Privacy Policy may also change. You can see the date on which the latest version of this Privacy Policy was posted. We reserve the right, at our complete discretion, to change, modify, add and/or remove portions of this Privacy Policy at any time. You should check our App frequently to see recent changes. You can see the date on which the latest version of this Privacy Policy was posted. Unless stated otherwise, our current Privacy Policy applies to all Personal Information we have about you. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of Personal Information collected in the past without informing affected customers and giving them a choice.
